10:30:59 AM Belgrade City-County Planner Jason Karp Staff Report, suggests changes to the following conditions and/or covenants: Adding the wording to Condition #3: At the end of the first sentence "and Waste Water System", Covenant #5e: Change wording from Belgrade Rural to "Central Valley" Fire District, Covenant #5i: Changing homeowners association to "Utility Solutions", Condition #24: At the end of the paragraph change any phase to "Phase 1", Condition #25: At the end of the first sentence add "Phases 2 & 5" and change in the second sentence, any phase to "Phase 1", Condition #26: After Jackrabbit Lane add "at the center of the subdivision between Hulbert and Valley Center", Condition #28: Remove the language "Lots abutting irrigation ditches may have water
rights as described in deeds.", Condition #30: Change the wording dedicated to the public as shown on the final plat to "preliminary plat", and add, "The final plat for a particular phase shall indicate that the open space is dedicated to the Homeowner's Association and parks are dedicated to the public as shown on the preliminary plat for that phase and as per the park, the park requirement summary in Tab EA-11 of the applicant submittal, Condition #31: adding "by the developer" after Parks and trails shall be constructed, Condition #36: After "prior to final plat approval add "to Phase 1", Adding a new Condition #37: If the subdivider chooses to have the Central Valley Fire District conduct the required testing and/or fire plan review, all fees for fire protection, water supply testing which is $300.00 plus $10.00 per hydrant and all fees for fire sprinkler system plan review and testing which is $200.00 per system shall be paid by the
subdivider as part of the application for final plat approval, adding an additional Condition #38: Regarding agricultural fencing with the type to be agreed upon with the adjacent land owners shall be installed along the western boundary of the subdivision when the subdivision abuts agricultural operations, prior to final plat approval of Phase 4 & 5, Add to condition #33: The development needs to be in a Water and Sewer District either annexed or formulated on their own.
